Glossary

Term:Definition:
The artist, pantacotta and ownerThe person who creates the commission.

Stage 1The consultation stage. In stage 1 the artist and client will discuss in detail what type of commission they want, the estimated cost, the timing and the terms will be confirmed during this stage. An official quote will be provided during this stage for the client.
Stage 2The payment stage. During stage 2, the commission invoice will be sent to the client and the client must pay the allotted total amount.
Stage 3The commission is in progress stage. In stage 3, the client will be updated every time the commission enters a new phase. The phases are labelled as, 1. Sketch, 2. Line Art, 3. Flat Colour, 4. Shading and 5. Details. Also, clients are allowed to request updates during this stage.
Stage 4The commission's delivery status stage. The finalised commission will be uploaded and transferred digitally to the online location choice chosen by the client.
Stage 5The closing stage. E.g., The commission is completed/closed stage.
Custom Emote CommissionEmote(s) that are designed specifically to meet the criteria laid out by the Client.
Commercial Use/Usage:Clients who want to use the commissioned artwork for non-personal use that involves an exchange of money or other considerations and promotes a business as a direct or indirect result of the client's use of the commissioned artwork.
Commercial License, Commercial Rights or Commercial Usage RightsLegal rights that allow the client to use a copyrighted work for commercial purposes under specific guidelines and limitations set out by the artist, pantacotta. May be sold, licensed or given away.
Extended Commercial Use/UsageClients that want to use the commissioned artwork for non-personal use under specific guidelines and limitations set out by the artist, pantacotta. May be sold, licensed or given away.
Flat feeA one-time fee that is paid instead of royalties.
Gross salesThe total amount of sales without any deductions.
Personal use/Non-commercial useFor use in personal, non-profit projects.
Royalty/RoyaltiesThe amount paid by a third party (the client) to the product's owner (the artist pantacotta) for the ongoing use of that product. The manufacturer pays the artist a percentage of their gross sales (income).
Royalty with advance upfrontAn advance that is payable upfront, which is deducted later from future royalties.
End ProductThe final result of an activity or process, especially the finished article in a manufacturing process.
Profile Picture (PFP) / IconIt refers to the image or picture that represents an individual on a social media platform.

TOS Abstract

  • All clients/customers/commissioners that choose to commission any work from the artist pantacotta automatically agree to abide by all the artists' current and future terms of service (TOS).

  • The TOS will always be referred to in cases of dispute.

  • Pantacotta's TOS is subject to change without notice.

  • Failure to comply with the TOS will result in the following:

  1. The immediate cancellation of the commission(s).

  2. The client/customers/commissioners lose rights to all aspects of the commission.

  3. A warning will be circulated to related vendors.

  4. In extreme cases, legal proceedings will be taken.


Office hours

  • All queries are only seen and taken care of within the stated working hours.

  • Please note that all times mentioned are in Australian Eastern Daylight Time (AEST).

  • The current working hours are Monday to Friday, 10:00 am to 5:00 pm. Note, Saturday and Sunday are not working days.

  • Working hours will be subject to local public holidays.

  • Queries sent in before or after the stated working hours will be promptly attended to on the next available workday.


The types of commission I, the artist pantacotta, will or will not accept.

  • I, pantacotta, am allowed to refuse any commission(s) that is perceived to be outside my scope of practice/abilities as an artist.

Additional Notes:

  • Requests to mimic different art styles may be approved on a case-by-case basis. The artist will only accept if they deem the style to be within their capabilities as an artist.

  • If the client wants to commission a piece based on an existing artwork style from the artist's portfolio, please make the artist aware of this preference during the consultation stage.


PAYMENT:

Payment service

  • Currently, PayPal is the only payment service offered.

  • All price listings and transactions are in Australian dollars (AUD).


Before the commencement of a commission:

  • Before commission(s) can commence, the commissioner must make the full payment during stage 2 i.e., the payment stage.

  • Any commission elements that have additional fees, as listed under the additional options, must also be paid upfront before the commencement of the commission(s).

  • No payment will be accepted until the commissioner and the artist have reached a final mutual agreement on ALL the commission(s) details during the consultation stage. This means that all details MUST first be approved by both the commissioner and artist, pantacotta before payment is permitted. Please note that any payment sent through before the mutual agreement over the commission details has been confirmed will be fully refunded.

  • Once all the details of a commission have been resolved during the consultation stage the commission will be forwarded to stage 2 i.e., the payment stage. An invoice detailing the entire order will be sent to the client at this stage.

  • The client's commission(s) will start after the artist receives the payment notification from PayPal. A verification email will be sent to the client from the artist confirming when the full payment has gone through. If the payment transfer is unsuccessful for any reason the client will be promptly notified about the issue. The commission will not start until the payment transfer to the artist is successful.


Grace period information:

  • The commissioner is responsible for informing the artist if any issues arise with payment transfer within a 1-week grace period.

  • Clients whose payments have not been received within 1 week will have their **commission cancelled **and the artist's focus will go towards the next commissioner in the queue.


Pricing information:

Character Commission Pricing:

The final price of the character commission(s) is dependent on the following factors:

  1. Model type e.g. Model 1, Model 2 or Model 3.

  2. Choice of colouring style e.g. Line art, Flat colours or Full colour.

  3. Positioning e.g. Head and Shoulder, Half body or Full body.

  4. If applicable any additional options e.g. Background, Props or Additional Characters.

  5. Fast-track e.g. If the client needs the commission to be completed within a specific time or a shorter time frame then additional fees will be charged. Please note, if the client does have strict time constraints it is important to make the artist aware of this fact immediately so that a judgement can be made about whether the commission(s) can be completed within the client's specified time frame.

  6. Commercial Use. e.g., Clients who want to use the commissioned artwork for non-personal use will need to purchase either a Commercial License or Extended Commercial License.

Profile Picture Commission Pricing:

  1. Model type e.g. Simple or Detailed.

  2. Choice of colouring style e.g. Line art, Flat colours or Full colour.

  3. Positioning e.g. Head, Head and Shoulder.

  4. If applicable any additional options e.g. Props or Additional Characters. Please note that 2 is the max number of characters that the artist will put in an icon.

  5. Fast-track e.g. If the client needs the commission to be completed within a specific time or a shorter time frame then additional fees will be charged. Please note, if the client does have strict time constraints it is important to make the artist aware of this fact immediately so that a judgement can be made about whether the commission(s) can be completed within the client's specified time frame.

  6. Commercial Use. e.g., Clients who want to use the commissioned artwork for non-personal use will need to purchase either a Commercial License or Extended Commercial License.

Additional note:

  • Any revision of the fees e.g., this may be due to [1] the client wanting to add additional items to the existing commission in later stages, [2] the client requesting any major changes to the existing commission, and/or [3] an incorrect invoice has been sent to the client.


Additional Fees Information:

  • The prices listed are the base prices. Any commission elements that meet the requirement for additional fees will have the extra charges automatically added to the base price. This will be reflected in the final quote.

  • Quotes are made on a case-by-case basis depending on the components chosen by the commissioner.

  • All additional fees are automatically added to the final quote and must be paid upfront with the base price.

  • Commissioners will receive a detailed invoice reflecting the client's requested items and listing the full fee.

  • A supplementary quote and/or invoice will only be sent if there is a pricing error.


Commercial License and Extended Commercial License:

Commerial Use Terms:

  • Clients who want to use the commissioned artwork for commercial purposes (either commercial use or extended commercial use) must notify the artist pantacotta during stage 1.

  • The client can also request to purchase the commercial rights to the commissioned artwork any time after stage 1. Please keep in mind that the artist holds the right to accept or decline this request since the commission was not created to be sold for commercial usage.

  • Commercial Use Commissions must give proper credit to the artist pantacotta using one of the following options:

  1. The client tags the artist using the appropriate handle for the social media site where the art will be uploaded, in connection to the post.

  2. The client includes the artist's Carrd Website in connection to the post.

  3. The artist will provide the client with a "for posting" version of the artwork with the artist's visible watermark. Providing credit as described in 1 and 2 is not needed if this version of the art is posted.

What does purchasing the commercial rights to the commissioned artwork entail?

  • It is IMPORTANT to note that purchasing the commercial use of the commission does NOT mean the client is buying the FULL RIGHTS to the commissioned artwork. Copyright is not automatically granted with the purchase of commercial rights.

  • By purchasing the commercial rights to the commissioned artwork, the client is purchasing limited rights to use pantacotta’s artwork for their product. This allows the clients the ability to reproduce and/or distribute the commissioned artwork for monetary gains as long as the clients are using the artwork within the mutually agreed upon terms and conditions.

  • Clients that want to purchase exclusivity rights require a separate discussion and contract between the client and the artist, pantacotta.

What is allowed by the Commercial License ✓

✓ The commissioned art can be used to create digital products for commercial use. This includes streaming assets such as Emotes, Banners, Website Elements, Icons, Stream and Page layouts.
✓ The commissioned art can be used to create digital or printed publications for commercial use. This includes Cards, Invitations, Photo Albums, Scrapbooks, Ebooks/ E-publications.✓ The commissioned art can be used to create digital or printed publications for commercial use. This includes Cards, Invitations, Photo Albums, Scrapbooks, Ebooks/ E-publications.
✓ Clients can only create up to a total of 5,000 individual End Products using the commissioned art. Overall the Client's End Products may sell a total of 5,000 copies combined.✓ Clients can only create up to a total of 250,000 individual End Products using the commissioned art. Overall the Client's End Products may sell a total of 250,000 copies combined. For clients who exceed the allowed number of sales or end products (250,000), the client has to purchase another license.
✓ The Client can use the commissioned artwork purchased with a Commercial License for Commercial Use in one owned and managed company social media presence. A separate license is required for each social media business presence.✓ The Client can use the commissioned artwork purchased with a Commercial License for Commercial Use in multiple owned and managed company social media presence. Please note, there are no limits on accounts owned and managed by the Client who purchased the Extended commercial use license.
✓ The client can use the commissioned artwork for the following marketing or advertising campaigns. Physical advertisement campaigns such as billboards, signage, collateral in local markets etc. Please note that Physical advertisements are limited to Local Markets under the Commercial License. For physical campaigns that reach a National or Global Market, an Extended Commercial License is required.✓ The client can use the commissioned artwork for the following marketing or advertising campaigns.Physical advertisement campaigns such as billboards, signage, printed advertisement, etc.
Digital advertisement campaigns such as, but not limited to, advertisements served by Google Ads, Facebook Ads, Instagram Ads, Twitter Ads, etc.Digital advertisement campaigns such as, but not limited to, advertisements served by Google Ads, Facebook Ads, Instagram Ads, Twitter Ads, etc.
-Television advertisements such as but not limited to commercials or promos.
✓ There are no limits on the number of impressions of social media posts or other digital advertisements incorporating the Licensed commissioned artwork for Commercial use or non-commercial use.✓ There are no limits on the number of impressions of social media posts or other digital advertisements incorporating the Licensed commissioned artwork for Commercial use or non-commercial use.
✓ The Client can use the commercial license for broadcasting and streaming via network, cable, internet, satellite, pay-per-view, video on demand or Streaming of motion picture and /or audiovisual works, including advertisements, are permitted for Commercial use.✓ The Client can use the commercial license for broadcast and streaming via network, cable, internet, satellite, pay-per-view, video on demand or Streaming of motion picture and /or audiovisual works, including advertisements, are permitted for Commercial use.
-✓ The client can use the extended commercial license for Digital development such as Website Software Development, Mobile App Development, Desktop Application Development, and Video Game Development: you may use the Licensed Asset in one title.
-✓ There are quantity limitations on Digital Development. The commissioned artwork can be used in a single website, application, or video game. Please note that each additional website, application, video game, or successor product, requires a separate license.
✓ The client can use the Commercially Licensed commissioned artwork to create E-book(s). The licensed commissioned artwork can be used in digital or print publications such as cards, invitations, photo albums, scrapbooks, E-books or E-publications that are for commercial or non-commercial use.✓ The client can use the Commercially Licensed commissioned artwork to create E-book(s). The licensed commissioned artwork can be used in digital or print publications such as cards, invitations, photo albums, scrapbooks, E-books or E-publications that are for commercial or non-commercial use.
  • Contact the artist at [email protected] if you are unsure whether what you want to do with the commissioned artwork falls under extended commercial use, commercial use or personal use.

The commercial purpose commission pricing and payment information

  • Clients who make it known during stage 1 commission discussions that they want a commissioned piece of art for commercial purposes (commercial use or extended commercial use) will have the (extended) commercial usage price automatically added to the final quote & invoice.

  • Clients who request to purchase (extended) commercial usage rights after stage 2 but whose commission is still in progress will have:

  1. their commission put on pause,

  2. a discussion about the new terms and conditions, which shall be mutually agreed upon between the artist and client,

  3. an invoice for commercial purpose commission shall be provided to the client and

  4. only once the invoice is paid off will the commission be taken off of pause and continued.

  • Clients who request to purchase the commercial usage rights after their commission has already been completed and received shall not use the artwork for non-personal use until:

  1. 1. the client and artist agree upon the new commercial use terms and conditions, and

  2. 2. the invoice is paid off in full.

  • The final commercial fee price differs per project and is decided by the artist on a case-by-case basis. and will be discussed and finalised between the client and the artist.

  • The following are factors that will affect the final commercial fee:

  • The type of project.

  • The use of the commissioned artwork.

  • The client's budget range.

  • The method of paying for art licensing. E.g., flat fee, royalty, or royalty with advance upfront.

  • Please note: Royalty rates depend on factors such as:

  • The type of product being produced. The price varies from product to product.

  • The quantities expected to be sold.

Commercial purpose commission guidelines and limitations of use

  • By purchasing a commercial purpose commission (extended commercial use or commercial use), the client automatically agrees and abides by the following commercial use restrictions.

  • Clients who express interest in using the commissioned artwork within the following related ventures will have their commercial use request denied:

  • Crypto-currency

  • Non-fungible tokens (NFTs)

  • Artificial Intelligence (AI) Learning Software

  • The commissioned artwork created by the artist, pantacotta is not permitted to be used in any connection to the above ventures.

  • Please note that the client will immediately lose all rights to commercially use the commissioned artwork for any personal or business-related purposes if the client is found to have breached any of the agreed-upon terms and conditions set by the artist, pantacotta.

  • Where needed, appropriate legal actions may be progressed to counter any breach of contract.

The Commission Process:

Commission use limits

  • All commissioned works from pantacotta are explicitly for personal use only unless the client purchases the commercial license or extended commercial license.

  • Clients who do not purchase the commercial license or extended commercial licence are prohibited from using commissions to gain profits, reselling, promotion and commercial purposes. Please note that the intellectual property will be retained by the artist.

Commissions timeline stages:

Pantacottas' art commissions go through the following 5 stages in this sequence.[Stage 1]
The consultation stage
E.g., the commission is labelled as either [1] 'consultation in progress' or [2] 'Ideas cemented'.
In stage 1 the artist and client will discuss in detail what type of commission they want, the estimated cost, the timing and the terms will be confirmed during this stage.Stage 2 of the commission will commence once the artist and client mutually agree on all details to do with the commission.An official quote will be provided during this stage for the client.Please note that once you agree to the quote you are committed to the commission and cancellation of the project may incur fees.[Stage 2]
The payment stage
E.g., the commission is labelled as either [1] 'payment pending' or [2] 'payment processed’.During stage 2, the commission invoice will be sent and the client must pay the allotted total amount before the commission commences to stage 3.[Stage 3]
The commission is in progress stage.
In stage 3, the client will be updated every time the commission enters a new phase.
The phases are labelled as, 1. Sketch, 2. Line Art, 3. Flat Colour, 4. Shading and 5. Details.
Clients are allowed to request updates during this stage.The commission will move to stage 4 once both the client and artist mutually approve of the final product.[Stage 4]
The commission's delivery status stage
E.g., the commission will be labelled as either [1] 'goods awaiting delivery confirmation' or [2] 'commission received.'The finalised commission will be uploaded and transferred digitally to the online location choice chosen by the client.[Stage 5]
The closing stage.
E.g., The commission is completed/closed stage.


Commission Turnaround/ work speed:

  • Commissions are selected and completed on a first-come-first-served basis unless a client purchased a fast-track option.

  • Clients who purchase a fast-track option will have their commission prioritised and moved to the front of the queue.


The commission completion length depends on the following:

Factors that can affect commission turnaround speed are:

  • The queue length at that current time.

  • The speed of communication between the client and the artist.

  • The payment processing speed.

  • The length it takes for both the artist and client to mutually agree on the final details of the commission.

  • The artist's health and living conditions.

  • Local public holidays (generally Australian).

  • The complexity of the commission.

  • Any extreme unforeseen changes to the commission.

Please Note:

Less complex commissions can be completed in a shorter time frame in comparison to more complex commissions.Commission turnaround can range from 2 weeks to 1 month. The client can expect continuous and clear communication about the commission(s) work-in-progress status via their choice of contact i.e., email or direct messaging (DMs).During stage 1 i.e., the consultation stage, the clients must inform the artist if there is a specific deadline or time constraints. This is because the commissions are eligible for additional fees if the client requires a fast turnaround speed.Clients that may be eligible for additional fees are judged on a case-by-case basis and are informed upfront during stage 1. Updates:

Please keep the following in mind when asking for commission updates.

  • All commission files sent during client requests or artist updates will be watermarked, and sent in low resolution and all the digital files are formatted and sent in PNG or JPEG format.

  • Any requests to remove the watermark will be refused. Watermarks are used to avoid potential theft or misuse of the commission.

  • Character Commission and Profile Picture Commission clients are offered unlimited update requests in stage 3 as explained in the commission timeline stages section.

  • Clients can request updates only when the commission enters stage 3 i.e., the commission is in progress stage.

  • The artist will only provide updates on the commission every time the commission enters a new stage or new phase, upon client request, if there are potential delays, and/or if there are elements of the commission that need further clarification.

  • All updates and communication between the commissioner and artist will be used as proof that the client's commission is being worked on.


Cancellations:

  • Any cancellation after stage 2 i.e., the payment stage, will incur fees.

  • For example, clients who request a full refund due to being unsatisfied with the product after all revisions are applied are not eligible for full refunds.

  • Additionally, when a commission cancellation is lodged, the client's rights to all parts of the commission are nullified and the artist is allowed to use this commission for personal or commercial usage. Note: the commission is rightfully the intellectual property of the artist, pantacotta.


Revision eligibility:

  • The Client is limited to 3 free revisions.

  • All additional revision requested after the three free revisions are used up requires an hourly fee that starts at $22.00 Aud per hour that is spent on the commission. The full payment needs to be paid upfront. Revisions to the client's commission will not be applied until the full payment has been transferred and confirmed by Paypal.

  • The deciding factor of whether a commission meets the qualifications for either ** free-of-charge** revision or extra-charge revision is decided on a case-by-case basis by the artist, pantacotta.

[1] The client's commission revision requests may be eligible for 'free-of-charge' revision if there are minor mistakes such as:

  • Small colour changes.

  • Missing accessories.

  • Missing background elements.

[2] The client's commission revision request may be eligible for an 'extra charge' revision if there are requests for major and/or detailed changes to the commission such as:

  • The entire outfit.

  • The full pose.

  • The full background.

  • Any considerable colour changes.

Please Note:

Extra charge revisions require an hourly fee of $22 per hour spent on the revision. Contact the artist at [email protected] for further information or queries.


Final product

Character Commission & Profile Picture Commission Final Product

  • The client can expect a high-resolution file of the finished product to be delivered over email.

  • Please keep in mind that NO PHYSICAL COPY of the completed artwork is being exchanged.

  • The product is purely digital.

  • The customer will receive their completed commissioned artwork in a JPEG or PNG format as per the client's request.

  • Clients can also request specific canvas sizes.

  • The final commissioned image has a resolution of 600 pixels per inch (PPI).

  • Keep in mind that there is no guarantee that the artist, pantacotta, will maintain a backup copy of the client's commission.

  • The artist holds no responsibility for any loss of product AFTER the client has sent a confirmation email that the digital goods have been successfully delivered and recieved.


Refunds / Cancellations/chargebacks

The most updated version of the TOS will be the basis for any refunds /cancellations.

Refunds

  • No full refunds for change of mind after stage 2 i.e., the payment stage.

  • After the completion of the commission, successful transit and client confirmation that the digital goods have been delivered the client is no longer eligible for a full refund for change of mind.

  • Commissioners requesting a full refund during or after the commission has entered stage 3 i.e., the commission is in progress stage, will be subjected to a case-by-case evaluation by the artist.


Chargebacks

  • In cases where chargebacks are filed AFTER the artist has fully completed and transferred the finalized commission files, the commissioner loses all rights to every element of the commission.

  • The client will be blacklisted and all future contact for collaborative work or commission requests will be declined. Any commission(s) currently in progress for the client will be terminated.

  • Warnings will be sent out to potential vendors and, if the circumstances call for it, the artist has the right to file complaints and/or report to refute the chargeback to gain appropriate compensation for the work and time that has been accomplished.


Cancellations

Keep in mind that the following factors are the ONLY conditions wherein the commission's situation will be reviewed by the artist and the client may be approved for a full refund.

  • If the artist feels that they are incapable of completing the commission, the commissioner will be notified immediately. Depending on the circumstances and the client's preference the commission will be either deferred, rescheduled or cancelled.

  • In lieu of cancellation, the commissioner may request a deferral. They will be refunded fully until which time the commission is ready to be recommenced and a new invoice will be issued. The commission will not be worked on until payment of the new invoice is actioned, per normal processes.

  • If the artist pantacotta cancels the client's commission due to unforeseen circumstances in the artist's life a full refund will be provided.

  • The commission(s) will be cancelled if the artist is unable to contact the client and/or if the client fails to keep in consistent contact with that artist during stage 1 i.e., the consultation stage, for further clarifications regarding commission details for more than 1 week.

Please note
In all cases of full commission cancellation, all files shared between the artist and the client rightfully belong to the artist and not the commissioner. The clients hold no rights to all files shared and are not permitted to utilise any of the commission documents for personal or commercial use.


Copyright and usage policy

The commissioner is entitled to:

  • ONLY use the commissioned artwork for personal use such as wallpapers, profile pictures, and gifts, print the artwork for personal use, non-profit websites and/or social media accounts. If there are any uncertainties about correct product usage, please contact the artist for further clarification at [email protected].

  • The client is allowed to claim the rights to their character(s) but not the commissions' creation process and/or end product which completely belongs to the artist pantacotta. Note, the artist retains all intellectual property to do with the commission.


The commissioner is NOT entitled to:

  • Profit off the commissioned artwork(s) including selling the commissioned artwork (s) physically or digitally unless the client purchases the Commercial licence or Extended Commercial licence to use the commission for non-personal use.

  • Post the commission on public websites without the proper credit to the artist pantacotta. Proper credit requires that the client either tags the artist using @pantacotta and/or includes the artist's Carrd website link to the post containing the commission.

  • Pass the image off as self-made. The commissions' creation process and/or end product completely belongs to the artist pantacotta. Note, the artist retains all intellectual property to do with the commission.


I, the artist pantacotta, am entitled to:

  • Use the commissioned artwork as a self-promotional tool, in online advertisement(s), and/or in any future online or hardcopy published work(s).

  • Upload and/or display all commissioned artworks.

  • Unless the commissioner requests otherwise, the artist is allowed to post all files related to the commission and the final commission publicly with the watermark. Permission from the commissioner will be requested beforehand.


Copyright infringement

Violating any of the following actions is considered an infringement of the artists', pantacotta, copyright.

Restrictions and penalties will be swiftly implemented for any person that infringes upon the artists', pantacotta, copyright, under the Copyright Act 1968.

  • All the artwork, commission processes and files that are created by pantacotta during the creation of the commission are not permitted to be used in any current or future blockchain-related technology for commercial or personal use i.e., NFTs and/or cryptocurrency.

  • Reproducing, taking credit for the artwork's creation distribution, tracing, editing/alteration(s) without the artist's consent and selling of any of pantacotta's artwork(s) is an infringement of copyright. Note that in Australian jurisdictions, Fair Dealing (Fair Use) exemptions may apply.

  • Copyright infringement will also occur if the client does not properly credit the artist, pantacotta when posting the commissioned artwork. Proper credit requires that the client either tags the artist using @pantacotta and/or includes the artist's Carrd website link to the post containing the commission.

  • The removal of watermarks and/or signatures from the commissioned art at any stage of completion.

  • If the completed commission is used for commercial purposes (Commercial use or Extended Commercial use) without purchasing the appropriate Commercial License or Extended Commercial Licence to use the commission for non-personal use from the artist, pantacotta.


The consequences of copyright infringement:

  • Clients that infringe upon the copyrights of the artist will have ALL rights to the commissioned art removed and future commission requests prohibited.

  • Warning(s) will be distributed to other potential vendors and, if necessary, appropriate legal actions and follow-ups will be taken to resolve the situation.

Privacy Policy


  • I, the artist pantacotta, wrote this policy to help you, the client/consumer/commissioner, understand what information is collected, how I use it and, what choices you have about it.

  • All personal and private data that is voluntarily submitted by the client will be appropriately handled and stored e.g., any information that may identify the client in some way such as your name, address, age, telephone number and email address.

  • I welcome any of your questions and comments on this policy.


Data Collection

  • The following data from the client is collected during the purchasing process e.g., PayPal’s invoicing system shares the client's email address and name with the artist pantacotta as part of the transaction process.

  • The artist has no control over the data stored and used by Paypal or any other future purchasing program. Information received by pantacotta during the commission process will be subject to the privacy policy above. Please see PayPal's privacy policy.

  • Please note, beyond the personal information required to purchase a commission, all personal information shared is up to the client's (own) discretion. If you do not want your personal information stored during the commission process please do not submit it.


How long do I keep your information

  • Every email or point of contact that is sent and shared between the artist and the client will be stored for an indefinite amount of time. [Reasons listed-under Use and Disclosure]


Use and Disclosure

  • The information within the emails will be used as evidence to settle any future enquiries or disputes that may arise.

  • The artist is not required to delete any of the emails or points of communication shared between the artist and the client.

  • The artist, pantacotta, will not share your sensitive personal information with any third parties without explicit consent from the client.

  • Your personal information may be used to respond to all your commission-related questions and requests. E.g., the client's email address and/or social media handle.

  • The collected data may be used to send you notifications on important updates such as news, events or deals related to any of the artists Digital art Business.


Choices you have about your information:

  • You can decide to stop getting any future notifications after your commission transaction is completed by simply informing the artist at any time by contacting pantacotta from [email protected].

  • The client can request access to the information that is collected and held about you as well as request details about why this information is being collected, and how and why it is being used or stored.


Age restriction

  • Children under the age of majority should ask guardians or parents for permission before disclosing any personal or private information.


Additional Important Information

  • Please note that all information under the privacy policy is subject to change without notice.

  • It is recommended that you review pantacotta's policies regularly for changes.

  • If you, the client/commissioner/customer, continue commissioning from the artist, Pantacotta, after those changes are in effect then you are automatically agreeing to the new policy.

  • If the changes are significant I will provide more prominent notice or get your consent as required by law.

Please note, if the client does have strict time constraints it is important to make the artist aware of this fact immediately so that a judgement can be made about whether the commission(s) can be completed within the client's specified time frame.

  • A small but less complex piece will take a shorter amount of time to complete which will equate to a lower final cost.

  • Whereas a small complex piece may take longer to complete which will equate to a higher final cost.

Body Art Tattooing BusinessAccording to NSW.gov.au “A ‘body art tattooing’ procedure is a tattooing procedure performed for decorative purposes. A ‘body art tattooing business’ is a business, which carries out body art tattooing procedures.”.

I am not a professionally licensed tattoo artist so I, the artist pantacotta, cannot and will not provide professional recommendations or services to do with tattoos.Finding appropriately sourced information and self-educating oneself on the topic is the sole responsibility of the client.


TOS Abstract

  • All clients/customers/commissioners that choose to commission any work from the artist pantacotta automatically agree to abide by all the artists' current and future terms of service (TOS).

  • The TOS will always be referred to in cases of dispute.

  • Pantacotta's TOS is subject to change without notice.

  • Failure to comply with the TOS will result in the following:

  1. The immediate cancellation of the commission(s).

  2. The client/customers/commissioners lose rights to all aspects of the commission.

  3. A warning will be circulated to related vendors.

  4. In extreme cases, legal proceedings will be taken.


Office hours

  • All queries are only seen and taken care of within the stated working hours.

  • Please note that all times mentioned are in Australian Eastern Daylight Time (AEST).

  • The current working hours are Monday to Friday, 10:00 am to 5:00 pm. Note, Saturday and Sunday are not working days.

  • Working hours will be subject to local public holidays.

  • Queries sent in before or after the stated working hours will be promptly attended to on the next available workday.


The types of commissions, the artist pantacotta, will not accept:

  • I, pantacotta, am allowed to refuse any commission(s) that is perceived to be outside my scope of practice/abilities as an artist.

What I will not do:

PAYMENT:

Payment service

  • Currently, PayPal is the only payment service offered.

  • All price listings and transactions are in Australian dollars (AUD).


Before the commencement of a commission:

  • Before commission(s) can commence, the commissioner must make the full payment during stage 2 i.e., the payment stage.

  • Any elements within the commission that require major alterations will incur additional fees that require a revision of the fees and must be paid for upfront before the commencement of the commission(s). The conditions that make the client eligible for additional fees are listed under the pricing information.

  • No payment will be accepted until the commissioner and the artist have reached a final mutual agreement on ALL the commission(s) details during the consultation stage. This means that all details MUST first be approved by both the commissioner and artist, pantacotta before payment is permitted. Please note that any payment sent through before the mutual agreement over the commission details has been confirmed will be fully refunded.

  • Once all the details of a commission have been resolved during the consultation stage the commission will be forwarded to stage 2 i.e., the payment stage. An invoice detailing the entire order will be sent to the client at this stage.

  • The client's commission(s) will start after the artist receives the payment notification from PayPal. A verification email will be sent to the client from the artist confirming when the full payment has gone through. If the payment transfer is unsuccessful for any reason the client will be promptly notified about the issue. The commission will not start until the payment transfer to the artist is successful.


Grace period information:

  • The commissioner is responsible for informing the artist if any issues arise with payment transfer within a 1-week grace period.

  • Clients whose payments have not been received within 1 week will have their **commission cancelled **and the artist's focus will go towards the next commissioner in the queue.


Pricing information:

The final price of a Custom Tattoo commission(s) is dependent on the following factors:

  1. Minimum Wage: Fair Work Commission sets the National Minimum Wage at $21.38 per hour as of the 1st of July 2022.

  2. Time (hourly): The time taken to complete the commission.

  3. Complexity. E.g., Simple or complex.

  4. Size. E.g., Small, Medium or Large.

  5. Fast-track E.g. If the client needs the commission to be completed within a specific time or a shorter time frame then additional fees will be charged. Please note, if the client does have strict time constraints it is important to make the artist aware of this fact immediately so that a judgement can be made about whether the commission(sn be completed within the client's specified time frame.

  6. Any revision of the fees e.g., this may be due to [1] the client wanting to add additional items to the existing commission in later stages, [2] the client requesting any major changes to the existing commission, and/or [3] an incorrect invoice has been sent to the client.

Complexity Examples:

  • A small but less complex piece will take a shorter amount of time to complete which will equate to a lower final cost.

  • Whereas a small complex piece may take longer to complete which will equate to a higher final cost.

  • A larger complex piece will take a longer amount of time to complete which will equate to a higher final cost.

  • Complexity is determined by the artist.


Additional Fees Information:

  • The prices listed are the base prices. Any commission elements that meet the requirement for additional fees will have the extra charges automatically added to the base price. This will be reflected in the final quote.

  • Quotes are made on a case-by-case basis depending on the components chosen by the commissioner.

  • All additional fees are automatically added to the final quote and must be paid upfront with the base price.

  • Commissioners will receive a detailed invoice reflecting the client's requested items and listing the full fee.

  • A supplementary quote and/or invoice will only be sent if there is a pricing error.


The Commission Process:

Commission use limits:

  • All commissioned works from pantacotta are explicitly for personal use only.

  • The clients are prohibited from using commissions to gain profits, reselling, promotion and/or commercial purposes. Note that the intellectual property will be retained by the artist.

  • Please note that commercial usage fees are NOT currently an option for Custom Tattoo Commissions. If further clarification is needed, please contact pantacotta at [email protected].

Pantacottas' Custom Tattoo design commissions go through the following 5 stages in this sequence.[Stage 1]The consultation stageE.g., the commission is labelled as either [1] 'consultation in progress' or [2] 'Ideas cemented'.In stage 1 the artist and client will discuss in detail what type of custom tattoo commission they want, the estimated cost, the timing and the terms will be confirmed during this stage.An official quote will be provided during this stage for the client.Stage 2 of the commission will commence once the artist and client mutually agree on all details to do with the commission.[Stage 2]
The payment stage
E.g., the commission is labelled as either [1] 'payment pending' or [2] 'payment processed’.
During stage 2, the commission invoice will be sent and the client must pay the allotted total amount before the commission commences to stage 3.Please Note
Once you agree to the quote in stage 1 and have completed payment in Stage 2 the client is committed to the commission and cancellation of the project may incur fees.

The commission is in progress stage.
In stage 3, the client will be updated every time the commission enters a new phase.
The phases are labelled as, 1. Sketch, 2. Line Art, 3. Flat Colour, 4. Shading and 5. Details.
Clients are allowed to request updates during this stage.The commission will move to stage 4 once both the client and artist mutually approve of the final product.[Stage 4]
The commission's delivery status stage
E.g., the commission will be labelled as either [1] 'goods awaiting delivery confirmation' or [2] 'commission received.'The finalised commission will be uploaded and transferred digitally to the online location choice chosen by the client.[Stage 5]
The closing stage.
E.g., The commission is completed/closed stage.


Commission Turnaround/ work speed:

  • Commissions are selected and completed on a first-come-first-served basis unless a client purchased a fast-track option.

  • Clients who purchase a fast-track option will have their commission prioritised and moved to the front of the queue.

Please Note:Less complex commissions can be completed in a shorter time frame in comparison to more complex commissions.Commission turnaround can range from 2 weeks to 1 month. The client can expect continuous and clear communication about the commission(s) work-in-progress status via their choice of contact i.e., email or direct messaging (DMs).During stage 1 i.e., the consultation stage, the clients must inform the artist if there is a specific deadline or time constraints. This is because the commissions are eligible for additional fees if the client requires a fast turnaround speed.Clients that may be eligible for additional fees are judged on a case-by-case basis and are informed upfront during stage 1. The commission completion length depends on the following:

Factors that can affect commission turnaround speed are:

  • Size. E.g., Small, Medium or Large.

  • Complexity. E.g., Simple or complex.

  • Fast-track E.g. If the client needs the commission to be completed within a specific time or a shorter time frame then additional fees will be charged. Please note, if the client does have strict time constraints it is important to make the artist aware of this fact immediately so that a judgement can be made about whether the commission(s) can be completed within the client's specified time frame.

For Example:

  • A small but less complex piece will take a shorter amount of time to complete which will equate to a lower final cost.

  • Whereas a small complex piece may take longer to complete which will equate to a higher final cost.

  • A larger complex piece will take a longer amount of time to complete which will equate to a higher final cost.

  • Whereas a larger but less complex piece may take a shorter amount of time and will equate to a lower final cost.


Updates:

Please keep the following in mind when asking for commission updates.

  • All commission files sent during client requests or artist updates will be watermarked, and sent in low resolution and all the digital files are formatted and sent in PNG or JPEG format.

  • Any requests to remove the watermark will be refused. Watermarks are used to avoid potential theft or misuse of the commission.

  • Custom Tattoo Design clients are offered unlimited update requests in stage 3 as explained in the commission timeline stages section.

  • Clients can request updates only when the commission enters stage 3 i.e., the commission is in progress stage.

  • The artist will only provide updates on the commission every time the commission enters a new stage or new phase, upon client request, if there are potential delays, and/or if there are elements of the commission that need further clarification.

  • All updates and communication between the commissioner and artist will be used as proof that the client's commission is being worked on.


Cancellations:

  • Any cancellation after stage 2 i.e., the payment stage, will incur fees.

  • For example, clients who request a full refund due to being unsatisfied with the product after all revisions are applied are not eligible for full refunds.

  • Additionally, when a commission cancellation is lodged, the client's rights to all parts of the custom tattoo commission are nullified and the artist is allowed to use this custom tattoo commission for personal or commercial use. Note: All aspects of the custom tattoo commission are rightfully the intellectual property of the artist, pantacotta.

  • The cancelled custom tattoo commission will be reused/resold as a flash tattoo.


Revision eligibility:

  • The Client is limited to 3 free revisions.

  • All additional revision requested after the three free revisions are used up requires an hourly fee that starts at AUD $22.00 per hour that is spent on the commission. The full payment needs to be paid upfront. Revisions to the client's commission shall not be applied until the full payment has been transferred and confirmed by Paypal.

  • The deciding factor of whether a commission meets the qualifications for either free-of-charge revision or extra-charge revision is decided on a case-by-case basis by the artist, pantacotta.

[1] The client's custom tattoo commission revision requests may be eligible for 'free-of-charge' revision if there are minor mistakes such as:

  • Small colour changes.

  • Missing small details E.g., the client wants the artist to revise minor elements that require superficial editing.

[2] The client's custom tattoo commission revision request may be eligible for an 'extra charge' revision if there are requests for major and/or detailed changes to the commission such as:

  • Change of mind: The client wants the artist to revise major elements of the commission that would require intensive editing of the initial idea. E.g., any considerable colour changes.

  • Any considerable design changes to the tattoo. E.g., The client wishes to entirely scrap the initial idea and start a new idea.

Final product

  • The client can expect a high-resolution file of the finished product to be delivered over email.

  • Please keep in mind that NO PHYSICAL COPY of the completed custom tattoo is being exchanged.

  • The product is purely digital.

  • The customer will receive their completed custom tattoo commission in a JPEG or PNG format as per the client's request.

  • The final commissioned image has a resolution of 600 pixels per inch (PPI).

  • Keep in mind that there is no guarantee that the artist, pantacotta, will maintain a backup copy of the client's commission.

  • The artist holds no responsibility for any loss of product AFTER the client has sent a confirmation email that the digital goods have been successfully delivered and recieved.

Please Note:

I do NOT work on skin. The only service I, the artist pantacotta, offer for this commission type is the custom creation of a DIGITAL TATTOO DESIGN. I do NOT provide professional tattooing services.It is important to keep in mind that the colour palette chosen during the custom tattoo commission with the artist pantacotta may need to be adjusted or changed by the client's chosen tattoo artist due to factors such as skin tones, tattoo artist skills, style or tools.


Refunds / Cancellations/chargebacks

The most updated version of the TOS will be the basis for any refunds /cancellations.

Refunds

  • No full refunds for change of mind after stage 2 i.e., the payment stage.

  • After the completion of the commission, successful transit and client confirmation that the digital goods have been delivered the client is no longer eligible for a full refund for change of mind.

  • Commissioners requesting a full refund during or after the commission has entered stage 3 i.e., the commission is in progress stage, will be subjected to a case-by-case evaluation by the artist.


Chargebacks

  • In cases where chargebacks are filed AFTER the artist has fully completed and transferred the finalized commission files, the commissioner loses all rights to every element of the commission.

  • The client will be blacklisted and all future contact for collaborative work or commission requests will be declined. Any commission(s) currently in progress for the client will be terminated.

  • Warnings will be sent out to potential vendors and, if the circumstances call for it, the artist has the right to file complaints and/or report to refute the chargeback to gain appropriate compensation for the work and time that has been accomplished.


Cancellations

Keep in mind that the following factors are the ONLY conditions wherein the commission's situation will be reviewed by the artist and the client may be approved for a full refund.

  • If the artist feels that they are incapable of completing the commission, the commissioner will be notified immediately. Depending on the circumstances and the client's preference the commission will be either deferred, rescheduled or cancelled.

  • In lieu of cancellation, the commissioner may request a deferral. They will be refunded fully until which time the commission is ready to be recommenced and a new invoice will be issued. The commission will not be worked on until payment of the new invoice is actioned, per normal processes.

  • If the artist pantacotta cancels the client's commission due to unforeseen circumstances in the artist's life a full refund will be provided.

  • The commission(s) will be cancelled if the artist is unable to contact the client and/or if the client fails to keep in consistent contact with that artist during stage 1 i.e., the consultation stage, for further clarifications regarding commission details for more than 1 week.

Please note
In all cases of full commission cancellation, all files shared between the artist and the client rightfully belong to the artist and not the commissioner. The clients hold no rights to all files shared and are not permitted to utilise any of the commission documents for personal or commercial use.


Copyright and usage policy

The commissioner is entitled to:

  • Post the commission on public websites with proper credit to the artist pantacotta for non-monetary purposes.

  • Choose what tattoo parlour or tattooist to get the custom tattoo from.

  • If need be, clients are allowed to let their chosen tattooist or tattoo parlour alter the custom tattoo. E.g., The client's tattooist or tattoo parlour may professionally recommend alterations to the custom tattoo to get the best outcome.

The commissioner is NOT entitled to:

  • Profit off the commissioned custom tattoo artwork(s) including selling the commissioned artwork (s) physically or digitally.

  • Post the commission on public websites without the proper credit to the artist pantacotta. Proper credit requires that the client either tags the artist using @pantacotta and/or includes the artist's Carrd website link to the post containing the commission.

  • Pass the image off as self-made. The commissions' creation process and/or end product completely belongs to the artist pantacotta. Note, the artist retains all intellectual property to do with the commission.


The client, commissioner, and customer are responsible for:

  • Finding and choosing appropriate tattoo parlours/vendors/studios to perform the tattoo procedure.

  • Conducting self-research on the tattooing process and appropriate tattoo aftercare.

  • ONLY use the commissioned custom tattoo for personal use.

  • If there are any uncertainties about correct product usage, do not hesitate to contact the artist for further clarification at [email protected].


The artist, pantacotta, takes no responsibility for:

  • Providing any form of body art tattooing procedure or services because this is not a Body Art Tattooing Business.

  • The artist is not responsible for any tattoo removal costs or damages, including during the tattoo healing stage.

  • Providing professional tattooing advice.

  • The artist takes no responsibility for the accuracy of the work of the client's chosen tattoo artist.


I, the artist pantacotta, am entitled to:

  • Use the commissioned artwork as a self-promotional tool, in online advertisement(s), and/or in any future online or hardcopy published work(s).

  • Upload and/or display all commissioned artworks.

  • Unless the commissioner requests otherwise, the artist is allowed to post all files related to the commission and the final commission publicly with the watermark.


Copyright infringement

Violating any of the following actions is considered an infringement of the artists', pantacotta, copyright.

Restrictions and penalties will be swiftly implemented for any person that infringes upon the artists', pantacotta, copyright, under the Copyright Act 1968.

  • All the artwork, commission processes and files that are created by pantacotta during the creation of the commission are not permitted to be used in any current or future blockchain-related technology for commercial use i.e., NFTs and/or cryptocurrency.

  • Reproducing, taking credit for the artwork's creation distribution, tracing, editing/alteration(s) without the artist's consent and selling of any of pantacotta's artwork(s) is an infringement of copyright. Note that in Australian jurisdictions, Fair Dealing (Fair Use) exemptions may apply.

  • Copyright infringement will also occur if the client does not properly credit the artist, pantacotta when posting the commissioned artwork. Proper credit requires that the client either tags the artist using @pantacotta and/or includes the artist's Carrd website link to the post containing the commission.

  • The removal of watermarks and/or signatures from the commissioned art at any stage of completion.

  • If the completed commission is used for commercial purposes.


The consequences of copyright infringement:

  • Clients that infringe upon the copyrights of the artist will have ALL rights to the commissioned art removed and future commission requests prohibited.

  • Warning(s) will be distributed to other potential vendors and, if necessary, appropriate legal actions and follow-ups will be taken to resolve the situation.

TOS Abstract

  • All clients/customers/commissioners that choose to commission any work from the artist pantacotta automatically agree to abide by all the artists' current and future terms of service (TOS).

  • The TOS will always be referred to in cases of dispute.

  • Pantacotta's TOS is subject to change without notice.

  • Failure to comply with the TOS will result in the following:

  1. The immediate cancellation of the commission(s).

  2. The client/customers/commissioners lose rights to all aspects of the commission.

  3. A warning will be circulated to related vendors.

  4. In extreme cases, legal proceedings will be taken.


Office Hours

  • All queries are only seen and taken care of within the stated working hours.

  • Please note that all times mentioned are in Australian Eastern Daylight Time (AEST).

  • The current working hours are Monday to Friday, 10:00 am to 5:00 pm. Note, Saturday and Sunday are not working days.

  • Working hours will be subject to local public holidays.

  • Queries sent in before or after the stated working hours will be promptly attended to on the next available workday.

Additional Notes:

  • Requests to mimic different art styles may be approved on a case-by-case basis. The artist will only accept if they deem the style to be within their capabilities as an artist.

  • If the client wants to commission a piece based on an existing artwork style from the artist's portfolio, please make the artist aware of this preference during the consultation stage.


Payment

Payment Service

  • Currently, PayPal is the only payment service offered.

  • All price listings and transactions are in Australian dollars (AUD).

Before the commencement of a commission

  • Before commission(s) can commence, the commissioner must make the full payment during stage 2 i.e., the payment stage.

  • Any commission elements that have additional fees, as listed under the additional options, must also be paid upfront before the commencement of the commission(s).

  • No payment will be accepted until the commissioner and the artist have reached a final mutual agreement on ALL the commission(s) details during the consultation stage. This means that all details MUST first be approved by both the commissioner and artist, pantacotta before payment is permitted. Please note that any payment sent through before the mutual agreement over the commission details has been confirmed will be fully refunded.

  • Once all the details of a commission have been resolved during the consultation stage the commission will be forwarded to stage 2 i.e., the payment stage. An invoice detailing the entire order will be sent to the client at this stage.

  • The client's commission(s) will start after the artist receives the payment notification from PayPal. A verification email will be sent to the client from the artist confirming when the full payment has gone through. If the payment transfer is unsuccessful for any reason the client will be promptly notified about the issue. The commission will not start until the payment transfer to the artist is successful.

Grace Period

  • The commissioner is responsible for informing the artist if any issues arise with payment transfer within a 1-week grace period.

  • Clients whose payments have not been received within 1 week will have their **commission cancelled **and the artist's focus will go towards the next commissioner in the queue.

Pricing Information

The final price of a commission(s) is dependent on the following factors:

  1. Commission Type e.g. Custom Emote Commission or YCH Emote Commission.

  2. Emote set e.g. 1 Custom Emote, 3 Custom Emotes set, 5 Custom Emotes set etc. The price is based on what set you choose.

  3. The Emotes Complexity e.g. Emotes that require a lot of details will be charged accordingly as it will take longer to create and complete.

  4. Fast-track e.g. If the client needs the commission to be completed within a specific time or a shorter time frame then additional fees will be charged. Please note, if the client does have strict time constraints it is important to make the artist aware of this fact immediately so that a judgement can be made about whether the commission(s) can be completed within the client's specified time frame.

  5. Commercial Use. e.g., Clients who want to use the commissioned artwork for non-personal use will need to purchase either a Commercial License or Extended Commercial License.

Additional note:

  • Any revision of the fees e.g., this may be due to [1] the client wanting to add additional items to the existing commission in later stages, [2] the client requesting any major changes to the existing commission, and/or [3] an incorrect invoice has been sent to the client.

Additional Fees Information

  • The prices listed are the base prices. Any commission elements that meet the requirement for additional fees will have the extra charges automatically added to the base price. This will be reflected in the final quote.

  • Quotes are made on a case-by-case basis depending on the components chosen by the commissioner.

  • All additional fees are automatically added to the final quote and must be paid upfront with the base price.

  • Commissioners will receive a detailed invoice reflecting the client's requested items and listing the full fee.

  • A supplementary quote and/or invoice will only be sent if there is a pricing error.


Commercial License and Extended Commercial License:

Commerial Use Terms:

  • Clients who want to use the commissioned artwork for commercial purposes (either commercial use or extended commercial use) must notify the artist pantacotta during stage 1.

  • The client can also request to purchase the commercial rights to the commissioned artwork any time after stage 1. Please keep in mind that the artist holds the right to accept or decline this request since the commission was not created to be sold for commercial usage.

  • Commercial Use Commissions must give proper credit to the artist pantacotta using one of the following options:

  1. The client tags the artist using the appropriate handle for the social media site where the art will be uploaded, in connection to the post.

  2. The client includes the artist's Carrd Website in connection to the post.

  3. The artist will provide the client with a "for posting" version of the artwork with the artist's visible watermark. Providing credit as described in 1 and 2 is not needed if this version of the art is posted.


What does purchasing the commercial rights to the commissioned artwork entail?

  • It is IMPORTANT to note that purchasing the commercial use of the commission does NOT mean the client is buying the FULL RIGHTS to the commissioned artwork. Copyright is not automatically granted with the purchase of commercial rights.

  • By purchasing the commercial rights to the commissioned artwork, the client is purchasing limited rights to use pantacotta’s artwork for their product. This allows the clients the ability to reproduce and/or distribute the commissioned artwork for monetary gains as long as the clients are using the artwork within the mutually agreed upon terms and conditions.

  • Clients that want to purchase exclusivity rights require a separate discussion and contract between the client and the artist, pantacotta.

What is allowed by the Commercial License ✓

Please note, there are no limits on accounts owned and managed by the Client who purchased the Extended commercial use license.
✓ The client can use the commissioned artwork for the following marketing or advertising campaigns. Physical advertisement campaigns such as billboards, signage, collateral in local markets etc. Please note that Physical advertisements are limited to Local Markets under the Commercial License. The commercial purpose commission pricing and payment information

  • Clients who make it known during stage 1 commission discussions that they want a commissioned piece of art for commercial purposes (commercial use or extended commercial use) will have the (extended) commercial usage price automatically added to the final quote & invoice.

  • Clients who request to purchase (extended) commercial usage rights after stage 2 but whose commission is still in progress will have:

  1. their commission put on pause,

  2. a discussion about the new terms and conditions, which shall be mutually agreed upon between the artist and client,

  3. an invoice for commercial purpose commission shall be provided to the client and

  4. only once the invoice is paid off will the commission be taken off of pause and continued.

  • Clients who request to purchase the commercial usage rights after their commission has already been completed and received shall not use the artwork for non-personal use until:

  1. 1. the client and artist agree upon the new commercial use terms and conditions, and

  2. 2. the invoice is paid off in full.

  • The final commercial fee price differs per project and is decided by the artist on a case-by-case basis. and will be discussed and finalised between the client and the artist.

  • The following are factors that will affect the final commercial fee:

  • The type of project.

  • The use of the commissioned artwork.

  • The client's budget range.

  • The method of paying for art licensing. E.g., flat fee, royalty, or royalty with advance upfront.

  • Please note: Royalty rates depend on factors such as:

  • The type of product being produced. The price varies from product to product.

  • The quantities expected to be sold.

  • The popularity (strength) of the artist or brand.


Commercial purpose commission guidelines and limitations of use

  • By purchasing a commercial purpose commission (extended commercial use or commercial use), the client automatically agrees and abides by the following commercial use restrictions.

  • Clients who express interest in using the commissioned artwork within the following related ventures will have their commercial use request denied:

  • Crypto-currency

  • Non-fungible tokens (NFTs)

  • Artificial Intelligence (AI) Learning Software

  • The commissioned artwork created by the artist, pantacotta is not permitted to be used in any connection to the above ventures.

  • Please note that the client will immediately lose all rights to commercially use the commissioned artwork for any personal or business-related purposes if the client is found to have breached any of the agreed-upon terms and conditions set by the artist, pantacotta.

  • Where needed, appropriate legal actions may be progressed to counter any breach of contract.

The Commission Process

Commission use limits

  • All commissioned works from pantacotta are explicitly for personal use only unless the client purchases the commercial license or extended commercial license.

  • Clients who do not purchase the commercial license or extended commercial licence are prohibited from using commissions to gain profits, reselling, promotion and commercial purposes. Please note that the intellectual property will be retained by the artist.

Commission timeline stages

Pantacottas' art commissions go through the following 5 stages in this sequence.[Stage 1]
The consultation stage
E.g., the commission is labelled as either [1] 'consultation in progress' or [2] 'Ideas cemented'.
In stage 1 the artist and client will discuss in detail what type of commission they want, the estimated cost, the timing and the terms will be confirmed during this stage.Stage 2 of the commission will commence once the artist and client mutually agree on all details to do with the commission.An official quote will be provided during this stage for the client.Please note that once you agree to the quote you are committed to the commission and cancellation of the project may incur fees.[Stage 2]
The payment stage
E.g., the commission is labelled as either [1] 'payment pending' or [2] 'payment processed’.During stage 2, the commission invoice will be sent and the client must pay the allotted total amount before the commission commences to stage 3.[Stage 3]
The commission is in progress stage.
In stage 3, the client will be updated every time the commission enters a new phase.
The phases are labelled as, 1. Sketch, 2. Line Art, 3. Flat Colour and 4. Additional Details (If required).
Clients are allowed to request updates during this stage.The commission will move to stage 4 once both the client and artist mutually approve of the final product.[Stage 4]
The commission's delivery status stage
E.g., the commission will be labelled as either [1] 'goods awaiting delivery confirmation' or [2] 'commission received.'The finalised commission will be uploaded and transferred digitally to the online location choice chosen by the client.[Stage 5]
The closing stage.
E.g., The commission is completed/closed stage.

Commission Turnaround/work speed:

  • Commissions are selected and completed on a first-come-first-served basis unless a client purchased a fast-track option.

  • Clients who purchase a fast-track option will have their commission prioritised and moved to the front of the queue.

The commission completion length depends on the following:

Factors that can affect commission turnaround speed are:

  • The queue length at that current time.

  • The speed of communication between the client and the artist.

  • The payment processing speed.

  • The length it takes for both the artist and client to mutually agree on the final details of the commission.

  • The artist's health and living conditions.

  • Local public holidays (generally Australian).

  • The complexity of the commission.

  • Any extreme unforeseen changes to the commission.

Please Note:Less complex commissions can be completed in a shorter time frame in comparison to more complex commissions.Commission turnaround can range from 2 weeks to 1 month. The client can expect continuous and clear communication about the commission(s) work-in-progress status via their choice of contact i.e., email or direct messaging (DMs).During stage 1 i.e., the consultation stage, the clients must inform the artist if there is a specific deadline or time constraints. This is because the commissions are eligible for additional fees if the client requires a fast turnaround speed.Clients that may be eligible for additional fees are judged on a case-by-case basis and are informed upfront during stage 1. Updates

Please keep the following in mind when asking for commission updates.

  • All commission files sent during client requests or artist updates will be watermarked, and sent in low resolution and all the digital files are formatted and sent in PNG or JPEG format.

  • Any requests to remove the watermark from draft images sent to the client will be refused. Watermarks are used to avoid potential theft or misuse of the commission.

  • Clients are offered unlimited update requests in stage 3 as explained in the commission timeline stages section.

  • Clients can request updates only when the commission enters stage 3 i.e., the commission is in progress stage.

  • The artist will only provide updates on the commission every time the commission enters a new stage or new phase, upon client request, if there are potential delays, and/or if there are elements of the commission that need further clarification.

  • All updates and communication between the commissioner and artist will be used as proof that the client's commission is being worked on.

Cancellations:

  • Any cancellation after stage 2 i.e., the payment stage, will incur fees.

  • For example, clients who request a full refund due to being unsatisfied with the product after all revisions are applied are not eligible for full refunds.

  • Additionally, when a commission cancellation is lodged, the client's rights to all parts of the commission are nullified and the artist is allowed to use this commission for personal or commercial use. Note: the commission is rightfully the intellectual property of the artist, pantacotta.

Revision eligibility

  • The Client is limited to 3 free revisions per Custom and YCH Emote.

  • All additional revision requested after the three free revisions are used up requires an hourly fee that starts at $22.00 Aud per hour that is spent on the commission. The full payment needs to be paid upfront. Revisions to the client's commission will not be applied until the full payment has been transferred and confirmed by Paypal.

  • The deciding factor of whether a commission meets the qualifications for either ** free-of-charge** revision or extra-charge revision is decided on a case-by-case basis by the artist, pantacotta.

[1] The client's commission revision requests may be eligible for 'free-of-charge' revision if there are minor mistakes such as:

  • Small colour changes.

  • Missing small details E.g., the client wants the artist to revise minor elements that require superficial editing.

[2] The client's commission revision request may be eligible for an 'extra charge' revision if there are requests for major and/or detailed changes to the commission such as:

  • Change of mind: The client wants the artist to revise major elements of the commission that would require intensive editing of the initial idea.

  • Any considerable design changes to the Emote. E.g., The client wishes to entirely scrap the initial idea and start a new idea.

Final product

Please keep in mind that NO PHYSICAL COPY of the completed artwork is being exchanged. The product is purely digital.

File format

  • The client will receive their completed commission in a JPEG or PNG format.

  • The emote background is fully transparent.

Emote Dimensions

  • The client will receive the commissioned emotes in three dimensions (500 x 500 px, 256 X 256 px, 112 x 112 px, 56 X 56 px, 28 X 28 px).

  • The aspect ratio for each emotes design is 1:1.

File Resolution

  • The final commissioned image has a resolution of 600 pixels per inch (PPI).

  • The client can expect a high-resolution file of the finished product to be sent via the customer's preferred method of communication. E.g., email.

File Management and Storage

  • Keep in mind that there is no guarantee that the artist, pantacotta, will maintain a backup copy of the client's commission.

  • The artist holds no responsibility for any loss of product AFTER the client has sent a confirmation email that the digital goods have been successfully delivered and received.

Please Note

The artist is not responsible for ensuring that the emote format meets the rules and guidelines of the platform the client chooses to use the commissioned emotes.
It is up to the client to ensure that the commissioned emotes adhere to and respect the policies of the social media platforms they choose to affiliate the emotes with.
The client is encouraged to forewarn the artist about adhering to specific policies when creating the commissioned emote.


Refunds / Cancellations/ Chargebacks

The most updated version of the TOS will be the basis for any refunds /cancellations.

Refunds

  • No full refunds for change of mind after stage 2 i.e., the payment stage.

  • After the completion of the commission, successful transit and client confirmation that the digital goods have been delivered the client is no longer eligible for a full refund for change of mind.

  • Commissioners requesting a full refund during or after the commission has entered stage 3 i.e., the commission is in progress stage, will be subjected to a case-by-case evaluation by the artist.

Chargebacks

  • In cases where chargebacks are filed AFTER the artist has fully completed and transferred the finalized commission files, the commissioner loses all rights to every element of the commission.

  • The client will be blacklisted and all future contact for collaborative work or commission requests will be declined. Any commission(s) currently in progress for the client will be terminated.

  • Warnings will be sent out to potential vendors and, if the circumstances call for it, the artist has the right to file complaints and/or report to refute the chargeback to gain appropriate compensation for the work and time that has been accomplished.

Cancellations

Keep in mind that the following factors are the ONLY conditions wherein the commission's situation will be reviewed by the artist and the client may be approved for a full refund.

  • If the artist feels that they are incapable of completing the commission, the commissioner will be notified immediately. Depending on the circumstances and the client's preference the commission will be either deferred, rescheduled or cancelled.

  • In lieu of cancellation, the commissioner may request a deferral. They will be refunded fully until which time the commission is ready to be recommenced and a new invoice will be issued. The commission will not be worked on until payment of the new invoice is actioned, per normal processes.

  • If the artist pantacotta cancels the client's commission due to unforeseen circumstances in the artist's life a full refund will be provided.

  • The commission(s) will be cancelled if the artist is unable to contact the client and/or if the client fails to keep in consistent contact with that artist during stage 1 i.e., the consultation stage, for further clarifications regarding commission details for more than 1 week.

Please note
In all cases of full commission cancellation, all files shared between the artist and the client rightfully belong to the artist and not the commissioner. The clients hold no rights to all files shared and are not permitted to utilise any of the commission documents for personal or commercial use.


Copyright and usage policy

The commissioner is entitled to:

  • ONLY use the commissioned artwork for personal use such as wallpapers, profile pictures, and gifts, print the artwork for personal use, non-profit websites and/or social media accounts. If there are any uncertainties about correct product usage, please contact the artist for further clarification at [email protected].

  • The client is allowed to claim the rights to their character(s) but not the commissions' creation process and/or end product which completely belongs to the artist pantacotta. Note, the artist retains all intellectual property to do with the commission.

The commissioner NOT entitled to:

  • Profit off the commissioned artwork(s) including selling the commissioned artwork (s) physically or digitally unless the client purchases the Commercial licence or Extended Commercial licence to use the commission for non-personal use.

  • Post the commission on public websites without the proper credit to the artist pantacotta. Proper credit requires that the client either tags the artist using @pantacotta and/or includes the artist's Carrd website link to the post containing the commission.

  • Pass the image off as self-made. The commissions' creation process and/or end product completely belongs to the artist pantacotta. Note, the artist retains all intellectual property to do with the commission.

I, the artist pantacotta, am entitled to:

  • Use the commissioned artwork as a self-promotional tool, in online advertisement(s), and/or in any future online or hardcopy published work(s).

  • Upload and/or display all commissioned artworks.

  • Unless the commissioner requests otherwise, the artist is allowed to post all files related to the commission and the final commission publicly with the watermark. Permission from the commissioner will be requested beforehand.

Copyright infringment

Violating any of the following actions is considered an infringement of the artists', pantacotta, copyright.

Restrictions and penalties will be swiftly implemented for any person that infringes upon the artists', pantacotta, copyright, under the Copyright Act 1968.

  • All the artwork, commission processes and files that are created by pantacotta during the creation of the commission are not permitted to be used in any current or future blockchain-related technology for commercial or personal use i.e., NFTs and/or cryptocurrency.

  • Reproducing, taking credit for the artwork's creation distribution, tracing, editing/alteration(s) without the artist's consent and selling of any of pantacotta's artwork(s) is an infringement of copyright. Note that in Australian jurisdictions, Fair Dealing (Fair Use) exemptions may apply.

  • Copyright infringement will also occur if the client does not properly credit the artist, pantacotta when posting the commissioned artwork. Proper credit requires that the client either tags the artist using @pantacotta and/or includes the artist's Carrd website link to the post containing the commission.

  • The removal of watermarks and/or signatures from the commissioned art at any stage of completion.

  • If the completed commission is used for commercial purposes (Commercial use or Extended Commercial use) without purchasing the appropriate Commercial License or Extended Commercial Licence to use the commission for non-personal use from the artist, pantacotta.

The consequences of copyright infringement:

  • Clients that infringe upon the copyrights of the artist will have ALL rights to the commissioned art removed and future commission requests prohibited.

  • Warning(s) will be distributed to other potential vendors and, if necessary, appropriate legal actions and follow-ups will be taken to resolve the situation.

TOS Abstract

  • All clients/customers/commissioners that choose to commission any work from the artist pantacotta automatically agree to abide by all the artists' current and future terms of service (TOS).

  • The TOS will always be referred to in cases of dispute.

  • Pantacotta's TOS is subject to change without notice.

  • Failure to comply with the TOS will result in the following:

  1. The immediate cancellation of the commission(s).

  2. The client/customers/commissioners lose rights to all aspects of the commission.

  3. A warning will be circulated to related vendors.

  4. In extreme cases, legal proceedings will be taken.

Office Hours

  • All queries are only seen and taken care of within the stated working hours.

  • Please note that all times mentioned are in Australian Eastern Daylight Time (AEST).

  • The current working hours are Monday to Friday, 10:00 am to 5:00 pm. Note, Saturday and Sunday are not working days.

  • Working hours will be subject to local public holidays.

  • Queries sent in before or after the stated working hours will be promptly attended to on the next available workday.

The types of commission I, the artist pantacotta, will not accept

  • I, pantacotta, am allowed to refuse any commission(s) that is perceived to be outside my scope of practice/abilities as an artist.

What I will not do:
Realism. E.g., Realistic portrait of people.

  • Requests to mimic different art styles may be approved on a case-by-case basis. The artist will only accept if they deem the style to be within their capabilities as an artist.

  • If the client wants to commission a piece based on an existing artwork style from the artist's portfolio, please make the artist aware of this preference during the consultation stage.

Payment

Payment Service

  • Currently, PayPal is the only payment service offered.

  • All price listings and transactions are in Australian dollars (AUD).

Before the commencement of a commission

  • Before commission(s) can commence, the commissioner must make the full payment during stage 2 i.e., the payment stage.

  • Any commission elements that incur additional fees must pay upfront before the commencement of the commission(s).

  • No payment will be accepted until the commissioner and the artist have reached a final mutual agreement on ALL the commission(s) details during the consultation stage. This means that all details MUST first be approved by both the commissioner and artist, pantacotta before payment is permitted. Please note that any payment sent through before the mutual agreement over the commission details has been confirmed will be fully refunded.

  • Once all the details of a commission have been resolved during the consultation stage the commission will be forwarded to stage 2 i.e., the payment stage. An invoice detailing the entire order will be sent to the client at this stage.

  • The client's commission(s) will start after the artist receives the payment notification from PayPal. A verification email will be sent to the client from the artist confirming when the full payment has gone through. If the payment transfer is unsuccessful for any reason the client will be promptly notified about the issue. The commission will not start until the payment transfer to the artist is successful.

Grace Period

  • The commissioner is responsible for informing the artist if any issues arise with payment transfer within a 1-week grace period.

  • Clients whose payments have not been received within 1 week will have their **commission cancelled **and the artist's focus will go towards the next commissioner in the queue.

Pricing Information

The final price of a commission(s) is dependent on the following factors:

  1. Payment options e.g., There are different payment options that the client can choose from. For example, the client can decide between Royalties, Royalties with advance upfront payment or a flat fee. This will be thoroughly discussed and finalised between the artist and the client during the consultation stage.

  2. Each book covers art pack is differently priced. E.g. There are 3 types of book cover commission packs. Pack 1 consists of just the front Book cover art. Pack 2 consists of the front book cover art and spine. Pack 3 consists of the front book cover art, the Book Spine and the Back cover art.

  3. The complexity of the Book Cover Art. Book Cover art that is less complex will have a lower final price than book cover art that is more complex. The artist will inform the client what category the commission falls under during the consultation stage. The final price will be discussed and finalised between the Client and Artist to ensure both parties are happy with the outcome.

  4. The number of revisions. E.g. The client is allowed 3 free revisions. All revisions requested by the client after the 3 free revisions have been used will incur extra charges. The artist will provide clear warnings every time a free revision is used up to ensure the client does not unknowingly incur extra charges.

  5. Fast-track e.g. If the client needs the commission to be completed within a specific time or a shorter time frame then additional fees will be charged. Please note, if the client does have strict time constraints it is important to make the artist aware of this fact immediately so that a judgement can be made about whether the commission(s) can be completed within the client's specified time frame.

  6. Commercial Use. e.g., Clients who want to use the commissioned artwork for non-personal use will need to purchase either a Commercial License or Extended Commercial License.

Additional note:

  • Any revision of the fees e.g., this may be due to [1] the client wanting to add additional items to the existing commission in later stages, [2] the client requesting any major changes to the existing commission, and/or [3] an incorrect invoice has been sent to the client.

Additional Fees Information

  • Quotes are made on a case-by-case basis depending on the components chosen by the commissioner.

  • All additional fees are automatically added to the final quote and must be paid upfront with the final base price.

  • Commissioners will receive a detailed invoice reflecting the client's requested items and listing the full fee.

  • A supplementary quote and/or invoice will only be sent if there is a pricing error.

Commercial License and Extended Commercial License:

Commerial Use Terms:

  • Clients who want to use the commissioned artwork for commercial purposes (either commercial use or extended commercial use) must notify the artist pantacotta during stage 1.

  • The client can also request to purchase the commercial rights to the commissioned artwork any time after stage 1. Please keep in mind that the artist holds the right to accept or decline this request since the commission was not created to be sold for commercial usage.

  • Commercial Use Commissions must give proper credit to the artist pantacotta using one of the following options:

  1. The client tags the artist using the appropriate handle for the social media site where the art will be uploaded, in connection to the post.

  2. The client includes the artist's Carrd Website in connection to the post.

  3. The artist will provide the client with a "for posting" version of the artwork with the artist's visible watermark. Providing credit as described in 1 and 2 is not needed if this version of the art is posted.

What does purchasing the commercial rights to the commissioned artwork entail?

  • It is IMPORTANT to note that purchasing the commercial use of the commission does NOT mean the client is buying the FULL RIGHTS to the commissioned artwork. Copyright is not automatically granted with the purchase of commercial rights.

  • By purchasing the commercial rights to the commissioned artwork, the client is purchasing limited rights to use pantacotta’s artwork for their product. This allows the clients the ability to reproduce and/or distribute the commissioned artwork for monetary gains as long as the clients are using the artwork within the mutually agreed upon terms and conditions.

  • Clients that want to purchase exclusivity rights require a separate discussion and contract between the client and the artist, pantacotta.

What is allowed by the Commercial License ✓

Please note, there are no limits on accounts owned and managed by the Client who purchased the Extended commercial use license.
✓ The client can use the commissioned artwork for the following marketing or advertising campaigns. Physical advertisement campaigns such as billboards, signage, collateral in local markets etc. Please note that Physical advertisements are limited to Local Markets under the Commercial License. The commercial purpose commission pricing and payment information

  • Clients who make it known during stage 1 commission discussions that they want a commissioned piece of art for commercial purposes (commercial use or extended commercial use) will have the (extended) commercial usage price automatically added to the final quote & invoice.

  • Clients who request to purchase (extended) commercial usage rights after stage 2 but whose commission is still in progress will have:

  1. their commission put on pause,

  2. a discussion about the new terms and conditions, which shall be mutually agreed upon between the artist and client,

  3. an invoice for commercial purpose commission shall be provided to the client and

  4. only once the invoice is paid off will the commission be taken off of pause and continued.

  • Clients who request to purchase the commercial usage rights after their commission has already been completed and received shall not use the artwork for non-personal use until:

  1. 1. the client and artist agree upon the new commercial use terms and conditions, and

  2. 2. the invoice is paid off in full.

  • The final commercial fee price differs per project and is decided by the artist on a case-by-case basis. and will be discussed and finalised between the client and the artist.

  • The following are factors that will affect the final commercial fee:

  • The type of project.

  • The use of the commissioned artwork.

  • The client's budget range.

  • The method of paying for art licensing. E.g., flat fee, royalty, or royalty with advance upfront.

  • Please note: Royalty rates depend on factors such as:

  • The type of product being produced. The price varies from product to product.

  • The quantities expected to be sold.

  • The popularity (strength) of the artist or brand.

Commercial purpose commission guidelines and limitations of use

  • By purchasing a commercial purpose commission (extended commercial use or commercial use), the client automatically agrees and abides by the following commercial use restrictions.

  • Clients who express interest in using the commissioned artwork within the following related ventures will have their commercial use request denied:

  • Crypto-currency

  • Non-fungible tokens (NFTs)

  • Artificial Intelligence (AI) Learning Software

  • The commissioned artwork created by the artist, pantacotta is not permitted to be used in any connection to the above ventures.

  • Please note that the client will immediately lose all rights to commercially use the commissioned artwork for any personal or business-related purposes if the client is found to have breached any of the agreed-upon terms and conditions set by the artist, pantacotta.

  • Where needed, appropriate legal actions may be progressed to counter any breach of contract.

  • If clients need clarification on these terms and conditions related to the restrictions on the use of the commissioned artwork, please contact [email protected].

The Commission Process

Commission use limits

  • All commissioned works from pantacotta are explicitly for personal use only unless the client purchases the commercial license or extended commercial license.

  • Clients who do not purchase the commercial license or extended commercial licence are prohibited from using commissions to gain profits, reselling, promotion and commercial purposes. Please note that the intellectual property will be retained by the artist.

Commission timeline stages

Pantacottas' art commissions go through the following 5 stages in this sequence.[Stage 1]
The consultation stage
E.g., the commission is labelled as either [1] 'consultation in progress' or [2] 'Ideas cemented'.
In stage 1 the artist and client will discuss in detail what type of commission they want, the estimated cost, the timing and the terms will be confirmed during this stage.Stage 2 of the commission will commence once the artist and client mutually agree on all details to do with the commission.An official quote will be provided during this stage for the client.Please note that once you agree to the quote you are committed to the commission and cancellation of the project may incur fees.[Stage 2]
The payment stage
E.g., the commission is labelled as either [1] 'payment pending' or [2] 'payment processed’.During stage 2, the commission invoice will be sent and the client must pay the allotted total amount before the commission commences to stage 3.[Stage 3]
The commission is in progress stage.
In stage 3, the client will be updated every time the commission enters a new phase.
The phases are labelled as, 1. Sketch, 2. Line Art, 3. Flat Colour and 4. Additional Details (If required).
Clients are allowed to request updates during this stage.The commission will move to stage 4 once both the client and artist mutually approve of the final product.[Stage 4]
The commission's delivery status stage
E.g., the commission will be labelled as either [1] 'goods awaiting delivery confirmation' or [2] 'commission received.'The finalised commission will be uploaded and transferred digitally to the online location choice chosen by the client.[Stage 5]
The closing stage.
E.g., The commission is completed/closed stage.

Commission Turnaround/work speed:

  • Commissions are selected and completed on a first-come-first-served basis unless a client purchased a fast-track option.

  • Clients who purchase a fast-track option will have their commission prioritised and moved to the front of the queue.

  • The commission's turnaround speed is judged on a case-by-case basis. A guesstimate will be available for the client during stage 1 of the commission process. So, during stage 1, the client must inform the artist if there is a specific deadline or time constraints. This will help the client and artist decide whether the art can be completed within the specified timeframe or the artist can provide the client with the option to request to fast-track their commission for an additional fee.

The commission completion length depends on the following:

Factors that can affect commission turnaround speed are:

  • The queue length at that current time.

  • The speed of communication between the client and the artist.

  • The payment processing speed.

  • The length it takes for both the artist and client to mutually agree on the final details of the commission.

  • The artist's health and living conditions.

  • Local public holidays (generally Australian).

  • The complexity of the commission.

  • Any extreme unforeseen changes to the commission.

Please Note:Less complex commissions can be completed in a shorter time frame in comparison to more complex commissions.The client can expect continuous and clear communication about the commission(s) work-in-progress status via their choice of contact i.e., email or direct messaging (DMs).Please contact the artist at [email protected] for further details or queries.

Updates

Please keep the following in mind when asking for commission updates.

  • All commission files sent during client requests or artist updates will be watermarked, and sent in low resolution and all the digital files are formatted and sent in PNG or JPEG format.

  • Any requests to remove the watermark from draft images sent to the client will be refused. Watermarks are used to avoid potential theft or misuse of the commission.

  • Clients are offered unlimited update requests in stage 3 as explained in the commission timeline stages section.

  • Clients can request updates only when the commission enters stage 3 i.e., the commission is in progress stage.

  • The artist will only provide updates on the commission every time the commission enters a new stage or new phase, upon client request, if there are potential delays, and/or if there are elements of the commission that need further clarification.

  • All updates and communication between the commissioner and artist will be used as proof that the client's commission is being worked on.

Cancellations:

  • Any cancellation after stage 2 i.e., the payment stage, will incur fees.

  • For example, clients who request a full refund due to being unsatisfied with the product after all revisions are applied are not eligible for full refunds.

  • Additionally, when a commission cancellation is lodged, the client's rights to all parts of the commission are nullified and the artist is allowed to use this commission for personal or commercial use. Note: the commission is rightfully the intellectual property of the artist, pantacotta.

Revision eligibility

  • The Client is limited to 3 free revisions.

  • All additional revision requested after the three free revisions are used up requires an hourly fee that starts at $22.00 Aud per hour that is spent on the commission. The full payment needs to be paid upfront. Revisions to the client's commission will not be applied until the full payment has been transferred and confirmed by Paypal.

  • The deciding factor of whether a commission meets the qualifications for either ** free-of-charge** revision or extra-charge revision is decided on a case-by-case basis by the artist, pantacotta.

[1] The client's commission revision requests may be eligible for 'free-of-charge' revision if there are minor mistakes such as:

  • Small colour changes.

  • Missing small details E.g., the client wants the artist to revise minor elements that require superficial editing.

[2] The client's commission revision request may be eligible for an 'extra charge' revision if there are requests for major and/or detailed changes to the commission such as:

  • Change of mind: The client wants the artist to revise major elements of the commission that would require intensive editing of the initial idea.

  • Any considerable design changes to the illustration. E.g., The client wishes to entirely scrap the initial idea and start a new idea.

Final product

Please keep in mind that NO PHYSICAL COPY of the completed artwork is being exchanged. The product is purely digital.If there is a certain industry format that the book art cover needs to adhere to to satisfy the requirements for digital print production-please inform and provide the guidelines for the artist, pantacotta, to follow.

File format

The final product will be saved and sent in either a JPEG or PNG file format. Please let the artist know if there's a preferred file format.

Dimensions

The dimensions are dependent on the customer's personal preferences. If the client has no preferences then the standard W X H for the book cover art that the artist pantacotta uses is [HXW].Clients are encouraged to have a preferred preference as the H X W of the commission could affect whether the client can use this commission for future physical print products.Please note, the spines W X H will depend on the number of pages in the book, the WH of the pages in the book, the paper stock this book will be printed on and more. It is wholly dependent on what print organisation the client partners with.

File Resolution

The default colour space the artist pantacotta uses is Krita's RGBA (RGB/Alpha).Please be aware that certain colour spaces are recommended if the client wants to eventually print their product in the future. It is the client's responsibility to inform the artist about their preferred colour space.

File Management and Storage

Keep in mind that there is no guarantee that the artist, pantacotta, will maintain a backup copy of the client's commission.The artist holds no responsibility for any loss of product AFTER the client has sent a confirmation email that the digital goods have been successfully delivered and received.

Refunds / Cancellations/ Chargebacks

The most updated version of the TOS will be the basis for any refunds /cancellations.

Refunds

  • No full refunds for change of mind after stage 2 i.e., the payment stage.

  • After the completion of the commission, successful transit and client confirmation that the digital goods have been delivered the client is no longer eligible for a full refund for change of mind.

  • Commissioners requesting a full refund during or after the commission has entered stage 3 i.e., the commission is in progress stage, will be subjected to a case-by-case evaluation by the artist.

Chargebacks

  • In cases where chargebacks are filed AFTER the artist has fully completed and transferred the finalized commission files, the commissioner loses all rights to every element of the commission.

  • The client will be blacklisted and all future contact for collaborative work or commission requests will be declined. Any commission(s) currently in progress for the client will be terminated.

  • Warnings will be sent out to potential vendors and, if the circumstances call for it, the artist has the right to file complaints and/or report to refute the chargeback to gain appropriate compensation for the work and time that has been accomplished.

Cancellations

Keep in mind that the following factors are the ONLY conditions wherein the commission's situation will be reviewed by the artist and the client may be approved for a full refund.

  • If the artist feels that they are incapable of completing the commission, the commissioner will be notified immediately. Depending on the circumstances and the client's preference the commission will be either deferred, rescheduled or cancelled.

  • In lieu of cancellation, the commissioner may request a deferral. They will be refunded fully until which time the commission is ready to be recommenced and a new invoice will be issued. The commission will not be worked on until payment of the new invoice is actioned, per normal processes.

  • If the artist pantacotta cancels the client's commission due to unforeseen circumstances in the artist's life a full refund will be provided.

  • The commission(s) will be cancelled if the artist is unable to contact the client and/or if the client fails to keep in consistent contact with that artist during stage 1 i.e., the consultation stage, for further clarifications regarding commission details for more than 1 week.

Please note
In all cases of full commission cancellation, all files shared between the artist and the client rightfully belong to the artist and not the commissioner. The clients hold no rights to all files shared and are not permitted to utilise any of the commission documents for personal or commercial use.

Copyright and usage policy

The commissioner is entitled to:

  • ONLY use the commissioned artwork for personal use such as wallpapers, profile pictures, and gifts, print the artwork for personal use, non-profit websites and/or social media accounts. If there are any uncertainties about correct product usage, please contact the artist for further clarification at [email protected].

  • The client is not allowed to claim the rights to the commissions' creation process and/or end product which completely belongs to the artist pantacotta. Note, the artist retains all intellectual property to do with the commission.

The commissioner NOT entitled to:

  • Profit off the commissioned artwork(s) including selling the commissioned artwork (s) physically or digitally unless the client purchases the Commercial licence or Extended Commercial licence to use the commission for non-personal use.

  • Post the commission on public websites without the proper credit to the artist pantacotta. Proper credit requires that the client either tags the artist using @pantacotta and/or includes the artist's Carrd website link to the post containing the commission.

  • Pass the image off as self-made. The commissions' creation process and/or end product completely belongs to the artist pantacotta. Note, the artist retains all intellectual property to do with the commission.

I, the artist pantacotta, am entitled to:

  • Use the commissioned artwork as a self-promotional tool, in online advertisement(s), and/or in any future online or hardcopy published work(s).

  • Upload and/or display all commissioned artworks.

  • Unless the commissioner requests otherwise, the artist is allowed to post all files related to the commission and the final commission publicly with the watermark. Permission from the commissioner will be requested beforehand.

Copyright infringment

Violating any of the following actions is considered an infringement of the artists', pantacotta, copyright.
Restrictions and penalties will be swiftly implemented for any person that infringes upon the artists', pantacotta, copyright, under the Copyright Act 1968.

  • All the artwork, commission processes and files that are created by pantacotta during the creation of the commission are not permitted to be used in any current or future blockchain-related technology for commercial or personal use i.e., NFTs and/or cryptocurrency.

  • Reproducing, taking credit for the artwork's creation distribution, tracing, editing/alteration(s) without the artist's consent and selling of any of pantacotta's artwork(s) is an infringement of copyright. Note that in Australian jurisdictions, Fair Dealing (Fair Use) exemptions may apply.

  • Copyright infringement will also occur if the client does not properly credit the artist, pantacotta when posting the commissioned artwork. Proper credit requires that the client either tags the artist using @pantacotta and/or includes the artist's Carrd website link to the post containing the commission.

  • The removal of watermarks and/or signatures from the commissioned art at any stage of completion.

  • If the completed commission is used for commercial purposes (Commercial use or Extended Commercial use) without purchasing the appropriate Commercial License or Extended Commercial Licence to use the commission for non-personal use from the artist, pantacotta.

The consequences of copyright infringement:

  • Clients that infringe upon the copyrights of the artist will have ALL rights to the commissioned art removed and future commission requests prohibited.

  • Warning(s) will be distributed to other potential vendors and, if necessary, appropriate legal actions and follow-ups will be taken to resolve the situation.

Additional Notes

  • Requests to mimic different art styles may be approved on a case-by-case basis. The artist will only accept if they deem the style to be within their capabilities as an artist.

  • If the client wants to commission a piece based on an existing artwork style from the artist's portfolio, please make the artist aware of this preference during the consultation stage.


Pricing information

The final price will be discussed and finalised between the Client and Artist during the consultation stage to ensure that both parties are satisfied with the total costs.The final price of a commission(s) is dependent on the following factors:

  1. Payment options e.g., There are different payment options that the client can choose from. For example, the client can decide between Royalties, Royalties with advance upfront payment or a flat fee. This will be thoroughly discussed and finalised between the artist and the client during the consultation stage.

  2. The estimated amount of time (ETA). All Book Cover commissions start at a minimum rate of $25.00 per hour. During the Consultation Stage, the artist will provide the client with an estimated amount of time the commissioned artwork will take to be completed.

  3. Each book cover art pack is differently priced. E.g. There are 3 types of book cover commission packs. Pack 1 consists of just the front Book cover art. Pack 2 consists of the front book cover art and spine. Pack 3 consists of the front book cover art, the Book Spine and the Back cover art.

  4. The complexity of the Book Cover Art. Book Cover art that is less complex will have a lower final price than book cover art that is more complex. The artist will inform the client what category the commission falls under during the consultation stage. The final price will be discussed and finalised between the Client and Artist to ensure both parties are happy with the outcome.

  5. The number of revisions. E.g. The Client is provided with a set amount of free revisions depending on what Book Cover Art Pack is chosen. All revisions requested by the client after the free revisions have been used will incur extra charges. The artist will provide clear warnings every time a free revision is used up to ensure the client does not unknowingly incur extra charges.

  6. Fast-track e.g. If the client needs the commission to be completed within a specific time or a shorter time frame then additional fees will be charged. Please note, if the client does have strict time constraints it is important to make the artist aware of this fact immediately so that a judgement can be made about whether the commission(s) can be completed within the client's specified time frame.

  7. Commercial Use.e.g., Clients who want to use the commissioned artwork for non-personal use will need to purchase either a Commercial License or Extended Commercial License.

Pantacottas' art commissions go through the following 5 stages in this sequence.

The consultation stage
E.g., the commission is labelled as either [1] 'consultation in progress' or [2] 'Ideas cemented'.
In stage 1 the artist and client will discuss in detail what type of commission they want, the estimated cost, the timing and the terms will be confirmed during this stage.
An official quote will be provided during this stage for the client.
Please note that once you agree to the quote you are committed to the commission and cancellation of the project may incur fees.
Stage 2 of the commission will commence once the artist and client mutually agree on all details to do with the commission.
Stage 2:
The payment stage
E.g., the commission is labelled as either [1] 'payment pending' or [2] 'payment processed’.
During stage 2, the commission invoice will be sent and the client must pay the allotted amount before the commission commences to stage 3.
Stage 3:
The commission is in progress stage.
In stage 3, the client will be updated every time the commission enters a new phase.
The phases are labelled as, 1. Sketch, 2. Line Art, 3. Flat Colour, 4. Shading and 5. Details.
Clients are allowed to request updates during this stage.
The commission will move to stage 4 once the client and artist mutually approve of the final product.
Stage 4:
The commission's delivery status stage
E.g., the commission will be labelled as either [1] 'goods awaiting delivery confirmation' or [2] 'commission received.'
The finalised commission will be uploaded and transferred digitally to the online location choice chosen by the client.
Stage 5:
The closing stage.
E.g., The commission is completed/closed stage.
